AGREEMENT TERMS AND CONDITIONS

1. Rates

Weekly Rates From

1 Bedroom Apartment
Sleeps 2, one double, from £350*

2 Bedroom Apartment

Sleeps 4, one double and one twin, from £450*

These rates are inclusive of all utilities, linen and towels.

*price based upon number of occupants. Whether serviced/self catering and time of year. Corporate and discounted rates are available for longer stays.

2. Deposit

A deposit (25% of total accommodation cost) is required to secure your booking. The remaining balance is due upon arrival.

3. Cancellation

In the event of cancellation 60 days (or more) prior to entry date, the deposit will be returned in full.

No refund will be made for cancellation within 60 days prior to entry date.

The full accommodation cost is still payable in the event of cancellation within 30 days prior to entry date.

4. Restrictions on Use

The Property will be used by the occupant as a residence for (in the case of an individual) the occupant and the occupant's family or (in the case of a company or business) the companies employees or contractors. The maximum number of occupants in the Property shall not exceed the number for which accommodation was booked for. Assigning or sub-letting the Property or any part thereof is prohibited. Paying guests and boarders are prohibited. Parties or gatherings in the Property are prohibited.

5. Period of occupancy

You are to remain in the property for the period specified at time of booking. The dates must not exceed those stated, unless agreed between the occupant/company who made the booking originally and the Owners.

6. Termination

No later than 9.15am on the Termination Date, the occupant will (1) vacate the Property (2) return the keys to the Property to the Owners and (3) leave the Property in accordance with the House Conditions

7. Condition of the property

The property must be left as it was found. Any occupant choosing not to leave the property in a clean and tidy condition on departure will be charged for any excessive cleaning costs.

8. Inventory

The Inventory will be provided to the occupant on the Date of Entry and will be checked at the Date of Entry by the occupant. In the event of there being any inaccuracies in the Inventory then the occupant shall notify these to the Owners on the Date of Entry, which failing the occupant shall be deemed to have accepted the contents of the Inventory.

9. No dogs or other animals are to be kept in the Property.

10. Smoking within the Property or in the remainder of the building is prohibited.

11. Conduct of occupant

If the occupant or any person or persons for whom the occupant may be responsible commits any form of harassment (whether verbal or physical) or conducts themselves in such a manner as to cause nuisance or distress to the Neighbours or as may be detrimental to the amenity of the Property or of Neighbouring Properties (as to which the Owners' decision shall be final) then such conduct will be held to be a material breach of the House Conditions and the occupant shall forfeit all rights under the Agreement and the Owners will be entitled to (One) require the occupant and any person or persons for whom he may be responsible to vacate the Property immediately and (Two) terminate the Agreement.

12. Inspection of the property

The Owners may enter the property at any time to carry out a check of the property and its contents, but will notify the guest first except in the case of an emergency or in the event that a guest is uncontactable.

13. Breakages, loss or damage

Breakages, loss or damage to the property or any of its fixtures/fittings must be reported to the Owners, and where necessary paid for, before departure. The occupant will not drive any nails into the walls or interfere in any way with the decoration or fixtures of the Property. The occupant will keep the Property in a clean and tidy condition and will leave the Property in such condition at the Termination Date, and will be responsible for any additional cleaning charges incurred by the Owners. Any breakages, loss or damage not reported and found after you have vacated the property will be charged to the debit/credit card used at time of booking. Fiona Mair Property does not accept responsibility for any items or personal belongings damaged whilst the guest resides in the property.

14. Failure to vacate on time

Without prejudice to any other remedies available to the Owners, in the event that the occupant does not vacate the Property and return the keys by 9.15am on the Termination Date then the Owners shall be entitled to charge the occupant for an additional day.

15. Definitions

In these terms and conditions the following words shall have the following meanings;

"Inventory" means an inventory of the Furniture, Fixtures and Fittings and condition of same prepared by the Owners as at the occupant's entry date

"Agreement" means the agreement (and any extension thereof) entered into between the Owners and the occupant incorporating these terms and conditions

"Maximum Number" means the maximum number of occupants specified in the Agreement

"Neighbouring Properties" means properties in the vicinity of the Property

"Neighbours" means the proprietors or occupiers of Neighbouring Properties

"Property" means the Property specified in the Agreement

"Term" means the period from the Date of Entry until the Termination Date

“Owners” mean Fiona Mair of Fiona Mair Property, registered at Cobblestock House, Station Road South, Peterculter, Aberdeen, AB14 OLL or Stephanie Mair of 1 Bucklerburn Park, Peterculter, Aberdeen, AB14 OLL.

"Termination Date" means the Termination Date specified in the Agreement
